Elon Musk is Now Going After NY AG Letitia James in Explosive Lawfare Battle

In a bold stand for free speech, Elon Musk’s X Corp has filed a lawsuit against New York Attorney General Letitia James, challenging the controversial “Stop Hiding Hate Act” as a blatant violation of the First Amendment. The law—championed by progressive officials including Governor Kathy Hochul and the Anti-Defamation League—requires social media companies to disclose their moderation policies and report instances where hate speech and misinformation are removed. According to X Corp, this legislation amounts to government overreach and unconstitutional compelled speech.

X argues that the New York law mirrors similar legislation in California, portions of which have already been blocked by the Ninth Circuit due to constitutional concerns. The platform contends that compelling companies to reveal how they moderate content—particularly politically charged topics—is a direct attack on the freedom of expression and editorial discretion.

Letitia James, long known for her partisan legal crusades, particularly against President Donald Trump, is once again in the spotlight. After the 2024 election, in which Trump was re-elected, James issued a public statement congratulating him—but with a caveat. She made clear her office was “prepared to fight back” against his America First policies, reinforcing her reputation as one of the president’s most aggressive political adversaries.

In its legal filing, X Corp stressed that, “Defining the boundaries of acceptable discourse online engenders considerable debate among reasonable people about where to draw the correct proverbial line. This is not a role that the government may play.” The statement underscores the company’s central argument: that a free and open internet cannot exist if state officials are empowered to dictate how speech is managed and reported.
